The Bloom

Terms and Conditions

These terms apply to your use of thebloom.rest and, from January 2027, to any order you place with The Bloom. They are governed by Finnish law. If you are a consumer resident in another EU/EEA country, nothing in these terms takes away the protections you are entitled to under the mandatory consumer-protection law of your own country of residence.

Part A: Using this website

1. Who we are

thebloom.rest is operated by Digital Luthier (Eerik Semen), trading as The Bloom, Business ID 3639616-6. Full contact details are in our Legal Notice.

2. Intellectual property

The Bloom name, logo, product photography, animations, and written content on this site belong to us or our licensors, unless stated otherwise. You may view and share pages of this site for personal, non-commercial purposes. You may not copy, reproduce, or reuse our branding, images, or text for commercial purposes without our written permission.

3. Content is provided "as is"

The blog and journal sections of this site are provided for general interest and information only - they are not professional, technical, or safety advice about instrument setup or maintenance. We take reasonable care to keep information accurate, but we do not guarantee that everything on the site is complete, current, or error-free.

4. Limitation of liability

To the fullest extent permitted by Finnish law, we are not liable for indirect or consequential loss arising from your use of this website (for example, lost profits or lost opportunities), or for temporary unavailability of the site. Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded under Finnish or EU law - including liability for death or personal injury caused by our negligence, for fraud, or any statutory right you have as a consumer.

5. Links to other websites

Our site may link to third-party websites. We are not responsible for the content, accuracy, or practices of sites we do not operate.

Part B: Buying from The Bloom (effective once ordering opens)

6. Placing an order

Product listings on this site are an invitation to order, not a binding offer from us. A contract is formed only once we send you an order confirmation by email. All prices are shown in EUR and include applicable Finnish VAT unless stated otherwise; delivery costs, if any, are shown separately before you complete checkout.

7. Payment

Payment is due at the time of ordering, via the payment methods offered at checkout [payment provider(s) to be named here once selected]. We do not store your full card details ourselves.

8. Delivery

[Delivery area, carrier, and estimated timeframes to be confirmed before launch - for example: "We aim to ship within X business days of your order to addresses in Finland/the EU."] Risk in the product passes to you once it is delivered to the address you provided.

9. Your right to cancel (14-day withdrawal right)

If you are a consumer, you have the right to withdraw from your order within 14 days of receiving your product, without giving any reason, under the Finnish Consumer Protection Act and the EU Consumer Rights Directive (2011/83/EU). To exercise this right, tell us clearly - by email to contact@thebloom.rest, or using the Model Withdrawal Form we provide - before the 14-day period ends.

If you withdraw, you must send the product back within 14 days of telling us, at your own cost unless we have agreed otherwise, and the product should be returned unused and in a condition that allows us to resell it. We will refund your payment, including standard delivery charges, within 14 days of either receiving the returned product or receiving evidence that you have sent it back, whichever is earlier. We may use the same payment method you used to pay, and we will not charge you a fee for the refund.

This right does not apply to goods made to your specification or clearly personalised, if we ever offer those. [If any future product is sealed for hygiene reasons and this exemption is intended to apply, that must be stated clearly on the specific product page before purchase - do not assume it applies by default.]

10. Legal guarantee of conformity

Regardless of any other warranty we may offer, consumers in the EU are entitled to a minimum two-year legal guarantee that goods are free from defects present at the time of delivery, under the Finnish Consumer Protection Act. This is a statutory right and cannot be limited or excluded by these terms. If your product is faulty, contact contact@thebloom.rest - we will first offer repair or replacement, and if that is not possible or reasonable, a price reduction or full refund.

11. Complaints and dispute resolution

If something goes wrong, please contact us first at contact@thebloom.rest so we can try to put it right. If we cannot resolve a complaint directly, Finnish consumers can bring it to the Consumer Disputes Board (Kuluttajariitalautakunta) free of charge, or seek advice from KKV's Consumer Advisory Service.

Part C: General

12. Force majeure

We are not liable for delay or failure to perform caused by circumstances beyond our reasonable control, including but not limited to natural disasters, transport disruption, or supplier failure.

13. Changes to these terms

We may update these terms from time to time; the version in force is the one published on this page at the time you place your order. Material changes will be dated and, where they affect an existing order, will not apply retroactively to that order.

14. Severability

If any part of these terms is found unenforceable, the rest continues to apply.

15. Governing law

These terms are governed by the laws of Finland. Any dispute will be handled by the competent Finnish courts, without prejudice to your right as a consumer to bring proceedings in the courts of your own country of residence within the EU, and without prejudice to your right to rely on the mandatory consumer-protection provisions of that country.
